1. TERMS AND CONCEPTS

 

1.1. Tender — is a competitive form of selection of proposals for the paid transportation of goods according to the previously announced Conditions, within the agreed time frame, based on the principles of competition, fairness and efficiency.

 

1.2. Initiator of the tender — any legal entity or individual entrepreneur registered on the Site, which initiates a tender with an indication of its Conditions.

 

1.3. Tender participant — any legal entity or individual entrepreneur registered on the Site, wishing to take part in the tender and having all the necessary means to do this (vehicles of the required capacity, etc.).

 

1.4. The Site — “an Internet site using the domain name lardi-trans.com, as well as other lardi-trans sites, in the countries of its presence.

 

1.5. Tender conditions — the terms of the tender determined by the Initiator of the tender (route, parameters of the transported freight, vehicle requirements, delivery price or bid step, delivery deadline, etc.).

 

1.6. Winner of the tender — a tender participant who submitted the best offer and who is selected by the Initiator of the tender based on the results of the tender.

 

2. GENERAL PROVISIONS

 

2.1. The purpose of the tender is to increase the efficiency of road freight operations, as well as to reduce costs and risks during transportation.

 

2.2. The main principles of organizing and holding tenders are the creation of equal competitive conditions for all transport companies, transparency, objectivity of assessment and the unity of requirements.

 

2.3. These Rules determine the general procedure for organizing and holding tenders for the transportation of goods on the Site, the conditions for the participation of potential carriers, the procedure for considering the offers of the Participants and making decisions by the Initiator of the tender.

 

3. TENDERS PRINCIPLES AND PROCEDURE

 

3.1. The Initiator of the tender has the right to submit an application for holding a tender by following the link: https://lardi-trans.com/tenders/ or by using other links on the lardi-trans website corresponding to his/her country of registration.

 

3.2. To activate the tender, the Initiator of the tender is obliged to fill in all available fields, providing complete, objective, truthful information about tender conditions. Filling out the information in the tender activation form should be done strictly in accordance with the designation of the fields.

 

3.3. It is forbidden to apply for a tender to come into contact with carriers, with no desire to hold a tender and the absence of a real need to transport goods.

 

3.4. By applying for a tender, the Initiator of the tender undertakes not to search for potential freight carriers outside the Site for the duration of the tender.

 

3.5. The tender time frame and the terms for determining its Winner are determined by the Initiator of the tender at his/her own discretion (minimum – 15 minutes, maximum – 30 days).

 

3.6. The Initiator of the tender has the right to:

  • set a fixed price for the transport of goods, or
  • provide an opportunity for the Tender participants to make offers for the price of freight transportation (less than the established tender price, taking into account the bid step determined by the Initiator of the tender)

3.6.1. Tender with a fixed price for the transport of goods.

3.6.1.1 For the duration of the tender with a fixed price, the tender participants who are satisfied with the Conditions proposed by the Initiator of the tender declare this to the Initiator of the tender. The first one to declare his/her consent to carry out transportation on the terms of the tender may be declared the Winner of the tender. In this case, the final decision on the Winner of the tender remains with the Initiator of the tender.

3.6.1.2 The Initiator of the tender has the right to either approve the Winner of the tender and close the tender, or cancel the tender and close it.

3.6.1.3 All Tender participants are sent appropriate notifications about the results of the tender: The winner of the tender – about his victory in the specified tender, other bidders will be notified that another participant of the tender has been selected as its Winner. At the same time, in case of cancellation of the tender, the Initiator of the tender sends all Participants a notice that the tender has been cancelled, indicating the reasons for its cancellation.

3.6.1.4 The winner of the tender undertakes to carry out transportation at a fixed price, which was established by the Initiator of the tender before its start.

3.6.1.5 In the absence of volunteers to transport goods for a fixed price, the tender is subject to closing.

3.6.2. Tender with no fixed price for transportation with the opportunity for Tender participants to submit their offers for the price of transportation of goods.

3.6.2.1 For the duration of the tender, all interested Tender participants submit their offers for the price of transportation, taking into account the Conditions stated by the Initiator of the tender.

3.6.2.2 The Initiator of the tender establishes the minimum bid step, which must be taken into account by the Tender participants when making their bids.

3.6.2.3 If there are bids from the Tender participants, the tender gets the status of "winner selection". The Initiator of the tender selects the winner on the basis of the minimum bid. In this case, the Initiator of the tender may use as a criterion for selecting the Winner other parameters of transportation besides its price (delivery time, vehicle condition, reputation of the carrier, etc.). The Initiator of the tender should decide on the Winner of the tender within 3 days from the moment of receiving the bid with the minimum price for transportation. During this time, the Initiator of the tender must select the Winner of the tender or to cancel the tender.

3.6.2.4 All Tender participants are sent appropriate notifications about the results of the tender: The winner of the tender – about his/her victory in the specified tender, other participants will be notified that another Tender participant has been selected as its Winner. At the same time, in case of cancellation of the tender, the Initiator of the tender sends all Participants a notice that the tender has been cancelled, indicating the reasons for its cancellation.

3.6.2.5 The winner of the tender undertakes to carry out transportation at the price declared during the auction and selected by the Initiator of the tender as the winning one.

3.6.2.6 In the absence of offers from the Tender participants, the tender shall be closed.

 

3.7. Tenders that were completed with the Winner cannot be removed and are available to the Initiator and the Winner of the tender.

 

4. RESTRICTIONS WHEN PLACING APPLICATIONS FOR TENDERS

 

4.1. It is forbidden to apply for holding tenders to the benefit of third parties and/or on behalf of individuals, legal entities or individual entrepreneurs who are not registered users of the Site.

 

4.2. It is forbidden to submit applications for holding tenders that contain offers other than offers for the freight transportation.

 

4.3. It is forbidden to use profanity and/or veiled profanity (in particular, but not exclusively, swear words (phrases), some letters of which are replaced by other symbols).

 

4.4. It is forbidden to write entire words in capital letters, with the exception of official names, titles and/or abbreviations.

 

4.5. It is forbidden to indicate in the application information that does not coincide with the information in the profile of the Initiator or the Participant of the tender.

 

4.6. It is forbidden to submit applications for holding a tender similar to those already available and posted on the Site (clones).

 

4.7. It is forbidden to write words using space-separated letters, for example, "K y i v" and so on.

 

5. GROUNDS FOR REMOVAL OF APPLICATIONS FOR TENDERS AND RESPONSIBILITY FOR VIOLATIONS OF THESE RULES

 

5.1. If the Initiator of the tender violates the provisions of clauses 3.3, 3.4, 4.1-4.6 of these Rules, the application for the tender is deleted, and the Initiator of the tender, who placed it, is blocked from submitting such applications.

 

5.2. The unblocking of the opportunity to apply for tenders is made by the Site administration after considering the appeal of the Initiator of the tender to the Site administration with an explanation of the reasons for the violation of the requirements of these Rules.

 

5.3. In case of repeated violation by the Initiator of the provisions of clauses 3.3, 3.4, 4.1-4.6 of these Rules, the said application for a tender is deleted, and the Initiator of the tender, who placed it, is blocked from submitting such applications forever.

 

5.4. In case of violation by the Participants of the tender of the provisions of subclauses 3.6.1.4 and 3.6.2.5 and clauses 4.3-4.5 of these Rules, the possibility of participation in such tenders is blocked for a period of 3 months.

 

5.5. The unlocking of the opportunity to participate in tenders is made by the Site administration after considering the user's appeal to the Site administration with an explanation of the reasons for the violation of the requirements of these Rules.

 

5.6. The administration of the Site reserves the right to remove applications for tenders that do not meet the requirements of the current legislation of Ukraine, the requirements of the User Agreement of the Site and the requirements of these Rules, as well as refuse the user to unblock the opportunity to submit applications for holding tenders or participate in them based on the results of consideration of the user's appeal.

 

6. REMOVAL OF OUTDATED TENDER APPLICATIONS

 

6.1. If an application for holding a tender is closed by its Initiator without determining the Winner, then the Initiator of the tender is obliged to remove the closed or outdated applications himself/herself.
